Psychopathic behavior?

As I understand it, psychopaths are people who never regret the bad things they do. If they cry when they are caught in doing bad things, they are sad that they got caught, not that they have any remorse over their actions. They do not seem to mind it at all when they hurt others. My question is, do you call this learned behavior? Or is it something that one has in their genetic makeup, and will present this behavior even as a small child?
