Traffic ticket: getting off on technicality?

I recently got a traffic ticket for "ping improperly." I ped on the left, but Section 1123 of the NYS Traffic and Vehicle Law (which I have been charged with violating) is the section the concerns limitations on ping on the right. The officer has acknowledged that I ped on the left. Is this enough cause for the charge to be dismissed?
